Please read these Explore my data (beta) Terms of Use (Terms) carefully before you access and use Explore my data (beta) (the Platform).
These Terms form a legal agreement between Jisc (we, us and our) as the provider of the Platform and any individual who accesses or uses the platform (a User, you and your).
By accessing or using the Platform in any way, you agree to be bound by these Terms. Use of the Platform includes browsing the Platform Website and accessing or using any of the Products provided on it (both terms as defined, below).
If you do not agree to these Terms, please do not use the Platform.
Section 1: General
- About the Platform: The Platform is available at www.data.jisc.ac.uk (the Platform Website), and allows users secure, user-friendly access to selected data and data products from Jisc’s Data Analytics product portfolio (Products). The Platform is secured with login and multifactor authentication utilising a permission system to allow you to see Products to which you are subscribed.
- About Jisc: The Platform is operated by Jisc, a registered charity and company limited by guarantee registered in England with company number 05747339 and having its registered address at 4 Portwall Lane, Bristol, BS1 6NB (Jisc).

- How these Terms apply: These Terms govern your access to and use of the Platform and apply to all Users. Individual Products available through the Platform have additional terms that apply to their use (Product Terms). In the event of any conflict between these Terms and any Product Terms, the Product Terms will prevail with respect to your use of that specific Product. We may update these Terms, and any Product Terms as outlined below.
- Privacy Policy: Our Privacy Policy also applies to your use of the Platform.
- Changes to terms: We may update these Terms and the Privacy Policy. Changes will have immediate effect from the date of posting on the Platform Website. Changes to Product Terms will be carried out in accordance with the relevant provisions contained within those Product Terms. All Platform Users should therefore review these Terms and any applicable Product Terms regularly. Your continued use of the Platform after changes have been made will be taken to indicate that you have accepted and are bound by the updated terms. We reserve the right to revoke, withdraw or amend these Terms or the Product Terms without notice, except as may be specified in the applicable Product Terms.
- Changes to the Platform: We may update and change the Platform from time to time, for example, to reflect changes to our Products or our Users' needs. We will try to give you reasonable notice of any major changes. We do not guarantee that the Platform, or any content on it, will be free from errors or omissions.
- We may suspend or withdraw the Platform: We do not guarantee that the Platform, or any content on it, will always be available or be uninterrupted. Use of the Platform and access to the Platform Website is permitted on a temporary basis. We may suspend or withdraw or restrict the availability of all or any part of the Platform Website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
- Viruses: We have designed the Platform following best practice in secure design and development however we cannot guarantee that the Platform is virus/bug free and advise that you use up-to-date browsers and virus protection software.
Section 2: Platform Access
- Access to the Platform is made available free of charge. Users can browse, view, and use the Products on the Platform Website, subject to the applicable Product Terms and in accordance with these Terms.
Section 3: Intellectual Property
- All content available on the Platform Website is the copyright of Jisc or licensed to Jisc.
- Your use of content is governed as follows:
- Product Terms: Where specific Product Terms apply, those terms will govern your rights to use the relevant content.
- Creative Commons: Unless otherwise specified in applicable Product Terms, certain data and analysis made available through the Platform is licensed to you under the Creative Commons Attribution-Non-Commercial 4.0 International (CC BY-NC-ND 4.0) licence. This content will be clearly marked. Under this licence, you must give appropriate credit to Jisc, provide a link to the licence, and indicate if changes were made. You may do so in any reasonable manner, but not in any way that suggests Jisc endorses you or your use. The full terms of the CC BY-NC-ND 4.0 licence are available online.
- All other content: For all other content not subject to Creative Commons licensing or Product Terms, you are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform in accordance with these Terms. This licence does not permit you to modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any such content.
- Jisc retains all right, title and interest in and to the Platform, including all related intellectual property rights. No rights are granted to you other than those expressly set forth in these Terms. Any intellectual property rights regarding specific Products are governed by the applicable Product Terms.
- We are not responsible for the content of any website that is linked to by the Platform or within a resource (whether under our control or not). Any link is not intended to be, nor should be construed as, an endorsement of any kind by us.
- If anything on the Platform is found to infringe the intellectual property rights of any third party, we will remove this as soon as possible after we are made aware of such infringement. If you think this is the case, then please get in touch at [email protected]
Section 4: Conditions Of Use For The Platform
All Users shall:
- Only access and use the Platform on these Terms.
Users shall not:
- Copy any content on the Platform Website, other than in accordance with these Terms except as expressly permitted under Specific Product Terms, Creative Commons licensing (as specified in Section 4), or other provisions of these Terms;
- Do anything which may cause (whether on purpose or not) the introduction or spread of a virus, Trojan horse, logic bombs, spyware or any other programs designed to affect the operation of any computer software or hardware;
- Attempt to gain unauthorised access to the Platform Website, the server on which the Platform Website is stored or any server or computer or database connected to the Platform Website;
- Attack the Platform Website via a denial-of-service attack or a distributed denial-of service attack;
- Act dishonestly or unprofessionally;
- Create a false identity on the Platform Website;
- Misrepresent your current or previous positions, professional qualifications, employment for, affiliation with any organisation or other accreditations;
- Use (or attempt to use) any other User’s log-in details (if applicable);
- Link to the Platform Website:
- In a way that damages our reputation or takes advantage of it;
- In a way that suggests any form of association, approval or endorsement on our part where none exists;
- Where we have withdrawn permission to link to the Platform Website;
- Sell, rent, lease, redistribute, broadcast, publicly display, transmit, communicate, modify, sub-license or transfer or assign any part of the Platform Website, or your rights to use the Platform Website (under these Terms) to any third party;
- Infringe our rights or the rights of any other User; or
- Use the Platform or the Platform Website unlawfully or fraudulently at any time.
Section 5: Breach Of These Terms
Where we reasonably believe or suspect that a User is in breach of these Terms (or any other terms referenced herein), we may take such action as we deem appropriate (at our discretion), including:
- Issuing a warning;
- Removing Users from accessing the Platform at any time, without warning;
- Taking legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
- Taking any further legal action against you; and/or
- Disclosing such information to law enforcement authorities as we reasonably feel is necessary.
Section 6: Accuracy Of Content
We may (without notice) update the Platform from time to time and may change or update the guidance and resources available on the Platform Website at any time.
The content and any guidance and resources made available on the Platform Website may be out of date at any given time, and we are under no obligation to update these. We do not guarantee that the Platform Website or any guidance or resource will be free from errors or omissions.

Section 7: Continuity Of Service
We do not guarantee that the Platform or the Platform Website, or any content on it, will always be available or be uninterrupted. Access to the Platform and use of the resources is permitted on a temporary basis. We will not be liable to you or to any third party if for any reason the Platform or the Platform Website is unavailable at any time or for any period.
Section 8: Liability
To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the Platform, the Platform Website or any guidance or resources made available on it, whether express or implied.
If we are liable to you in relation to your use of the Platform for any cause whatever, and regardless of the form of the action then, unless the law says otherwise, we will only be responsible to you for loss or damage you suffer (i) that is a foreseeable result of our breach of these Terms; and (ii) up to a maximum of five hundred pounds sterling (£500).
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
By using the Platform or Platform Website, each User agrees that, if we suffer any losses, damages or expenses as a result of that User's use of the Platform or Platform Website, that User will reimburse us for any such losses that are incurred as a result of that User's breach of (or failure to comply with) these Terms.

Section 10: Complaints
We have an internal complaints procedure. We aim to handle all complaints efficiently and quickly. If you have complaints regarding the Platform please follow the process outlined on our website.
Section 11: Miscellaneous
- No partnership: Users acknowledge that these Terms do not create or imply any partnership, joint venture or trust relationship between us and any User.
- Entire agreement: These Terms, any applicable Product Terms, and the Privacy Policy collectively contain all the terms applicable to the use of the Platform and Platform Website by you, and form the entire agreement between you and us.
- Invalidity/enforceability: Each of the terms of these Terms operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.
- No waiver: If we fail to insist that you perform any of your obligations, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. Any waiver would need to be given by us in writing.
- Matters outside of our control: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms if that is caused by events outside our reasonable control.
- Notices to you: These Terms and the Privacy Policy are drawn up in the English language. All written communications between you and us relating to these Terms and the Privacy Policy will be given in English. We will send any notices relating to any of the matters set out in these Terms to the email address you use to access the Platform.
- Governing law: These Terms and any dispute in relation to the materials available from the Platform will be governed by laws of England and Wales.
- Jurisdiction: The English courts have exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms or use of the Platform and/or Platform Website.
